Agreement and authority
By creating a Client Portal account, requesting an audit, or accessing the Client Portal, the individual acting for the business accepts these Client Portal Terms and the Savage Strategic Terms of Service. The individual represents that they have authority to bind the business and to grant the permissions stated here.
If the individual does not have that authority or the business does not agree, they must not create an account, submit an audit request, connect a source, or access the Client Portal.
Marketing-use license
To the fullest extent permitted by applicable law, the business grants Savage Strategic, its affiliates, contractors, successors, and marketing partners a worldwide, perpetual, irrevocable, transferable, sublicensable, royalty-free license to use, reproduce, adapt, edit, combine, publish, distribute, publicly display, publicly perform, and otherwise exploit Client Materials for Savage Strategic marketing, advertising, sales, portfolio, case-study, recruiting, educational, and promotional purposes in any media now known or later developed.
Client Materials include the business name, trade names, logos, branding, website, public-facing content, non-confidential business information, audits, findings, reports, deliverables, work product, strategies, project artifacts, screenshots, before-and-after materials, performance data, metrics, results, testimonials, reviews, statements, and any other materials, information, or outcomes created, supplied, observed, or documented in connection with the business relationship, an audit, a proposal, a service, or the Client Portal.
The license permits Savage Strategic to identify the business, describe the engagement, publish and promote audit findings, work, and results, prepare derivative materials and summaries, and use excerpts or full materials without further approval, review, notice, attribution, or compensation to the business or its representatives. A withdrawal, account closure, completed engagement, or termination does not revoke previously granted rights, except where non-waivable law requires otherwise.
Business responsibility and priority of this license
The business represents and warrants that it owns or controls the Client Materials and has secured every permission, release, license, notice, and authority needed for Savage Strategic to use them as these terms allow. The business will not provide material subject to an obligation that prevents this use unless it first obtains Savage Strategic written agreement to a different restriction.
Unless a later written agreement signed by an authorized Savage Strategic representative expressly identifies particular material and expressly overrides this marketing-use license, this marketing-use license controls over a conflicting informal instruction, portal note, request, or confidentiality marking.
Calls, meetings, recordings, and third-party information
The marketing-use license covers business-side meeting and communication materials, including Zoom or other meeting recordings, video, audio, transcripts, screenshots, chat, and other engagement records, only when Savage Strategic has obtained every notice and consent required from the individuals whose communications or likenesses are involved. The business is responsible for informing its attendees and obtaining any authority it is required to obtain before inviting them to a recorded or documented engagement.
Nothing in these terms authorizes Savage Strategic to publish credentials, payment-card data, protected health information, or personal information of the business customers, leads, employees, or other third parties when that publication would violate applicable law, provider terms, or a non-waivable right. Those legal limits do not narrow the business license for all other Client Materials.
